Act.Pl.let us know whether 2nd oct is the compulsory Holiday in India? Is it a National Holiday? Our office is suitated in Pune and branch is at Thane-(in Maharashtra) We have not yet declared Holiday, as Our Management wants clear decision in this matter.your early action is this regard will be highly appreciate.

Dear Jayant,
Yes it is a national holiday, as there are normally 4 national holidays which are - 26th January, 01st May, 15th August, 02nd October. As you are functioning within Maharashtra and if you falls under Maharashtra S&E act then it is compulsory for you to give 8 days as paid holiday to your staff.

Dear all,
National Holidays Act is applicable to all factories, Shops and Establishments , so also to your organization. 2nd Oct. , Mahatma Gandhi Jayanti is declared holiday, it is compulsory a non-working day.

Dear All,
What if staff has not been holiday on mention National Holidays as mentioned by Mr. RDS Yadav. If it is managements decision that there is no holiday and they have to work,. Many Private companies had not given holiday on 02nd October.
No staff can question management, as there decision is final.
In this case, even HR can't do anything.

I agree with the opinion of Sakhi12. However, if you look from the eyes of Labour Laws,
2nd Oct is a National Holiday. The State National & Festival Holidays Act also supports
this view.
Hence it is for management to decide whether 2nd Oct should be declared as Holiday, or
not.
