Respected sir,
Am working in a central govt organisation since march 2011. Am not a permanent employee, am outsourced through a company. we are 12 physicians working here. all 12 are contract basis staffs outsourced from a private concern. now am pregnant. The authorities say that such procedure is not applicable to outsourced contract employees and we are no where related to the Institution we work. they said me to contact the company which pay us the salary. when I contacted them they said that if the director in the central govt institution where I work issue a sanction letter then they would give us maternity leave with benefit.Now what should I do sir?
WHether i can claim for my benefits or am not eligible for this?

The Maternity benefit Act is applicable to every woman even if employed through an outside agency. Thus You are entitled to the maternity benefit since you have been working since March 2011.

Since your employer is Sigma HR solutions and not the National Institute of Naturopathy, Sigma should give you maternity benefits. Whether the Sigma (contractor) can shift his liability to National Institute (Principal employer) is their head ache and you have nothing to do with it. Therefore, you may claim the benefits from Sigma from whom you get salary for the work done by you for National Institute.
