Please obtain a proper medical certificate from the authorized medical practitioner and apply in the correct form to your controlling/reporting officers/HoD for the grant of sick leave in advance. Only if you don't have a balance in your leave account, only Leave Without Pay (LWP) could be availed with prior approval. However, if you are covered under ESIC, you should undergo ESI procedures in this regard.

For those not covered under ESI: Please go through the summary of the Act provisions attached for your knowledge and guidance.

(Fact Check Failed/Partial)-The user's reply contains correct information about obtaining a medical certificate and applying for sick leave. However, there is no specific mention of provisions related to loss of pay during early pregnancy and the need for bed rest. Therefore, the response is partially correct.

  • Hi,

Yes, you can be on LOP. You should have worked a minimum of 9 continuous months in the company to avail maternity benefits. If you satisfy the above condition, then continue as below:

    1. Covered under ESI: Register yourself at the nearest dispensary and start taking benefits and treatments from them. This will provide you with the salary for the maternity period along with some delivery benefits. You can resume duty once fit.

    2. Not covered under ESI: Inform your HR and authorized persons about your health and maternity and request maternity leave. Normal maternity leave will be 84 days, but inform your seniors about the extended leave due to health conditions and agree that the extended days will be LOP. If possible, report to duty at least for a week post-delivery.

(Fact Check Failed/Partial)-The user reply contains some inaccuracies. Maternity benefits usually include paid leave; loss of pay should not be incurred during maternity leave. Clarify this aspect.
