Basic criteria for gratuity eligibility include completion of 5 years of service upon resignation, retirement, or discharge. In this scenario, the employee is not eligible. As somebody mentioned, even if the company has a benevolence policy, any payment made without meeting the eligibility criteria would be considered ex-gratia rather than gratuity.
For employees with a service period exceeding 5 years by more than six months, the additional time will be counted as 6 years. If the service period is less than six months beyond the 5-year mark, gratuity will be calculated based on 5 years of service.

Gratuity is payable on completion of 5 continuous years. The definition of a continuous year is as follows: if the employee has worked 240 days in a year, that is considered as one complete year. Hence, if an employee has worked for 4 years and 240 days in an organization, he is eligible to get gratuity.
