I received an offer letter from the company in which they have mentioned my job profile, pay structure, and notice period (60 days) along with the following three conditions:

1. Employment will be confirmed subject to document verification of provided documents.
2. The appointment letter will be issued to you within one month of accepting the offer letter.
3. The notice period will be 60 days.

Now:

(a) First, I rejected the offer. Then after some telephonic discussions, they promised several things and said that it would be mentioned in my appointment letter. I accepted the offer, but by then, the offer had already expired (the acceptance deadline is mentioned in the document).

(b) I joined the organization on 1st November 2018 (the offer letter stated the joining date as 8th October 2018).

(c) During my tenure, I asked HR several times to issue my appointment letter, but I received no response. I also did not receive the benefits promised over the phone.

(d) Considering the above circumstances, I resigned from the organization on 2nd January 2019. Since then, I remained in touch with my manager and colleagues over the phone. However, on 20th January, I received an Absconding email from HR, stating that I was terminated due to being absent without notice and that 3 months' salary (CTC) would be recovered.

How should I proceed?

1. I have not received any official appointment letter confirming my employment. What is my status?
2. Since the offer was initially rejected and not accepted within its validity date, is it still valid?
3. How should I proceed to resolve this matter and exit the organization, as I do not wish to continue with them?

Based on the situation described, here are the steps you can take to address the issues:

1. Employment Status:
- Without an official appointment letter confirming your employment, your status may be considered unclear. However, your actions such as joining the organization and working there could imply an informal agreement. Seek clarification on your employment status from HR or legal counsel.

2. Validity of Offer:
- Since you initially rejected the offer and then accepted it after the expiration date, the validity of the offer may be questionable. Clarify this with HR to understand the current status of your employment contract.

3. Resolving the Matter:
- Contact HR immediately to discuss the situation and request the issuance of your appointment letter and clarification on the absconding email. Document all communications for future reference.
- If HR does not respond or resolve the issue satisfactorily, consider seeking assistance from a legal advisor or labor authority in Nainital, India, to understand your rights and options.
- If you do not wish to continue with the organization, express your intention formally in writing, citing the lack of clarity regarding your employment status and the issues faced during your tenure.

It is crucial to handle this matter promptly and professionally to protect your rights and ensure a fair resolution. Consulting with legal experts can provide you with guidance tailored to the specific labor laws and regulations in India.
