Dear Team,
Please help me. I am working in one company, and recently I got a job offer from another company, but they are asking me to join immediately. My current employer is not relieving me, and I have accepted to pay one month's basic salary, but my operations manager has not accepted it. He asked me to serve the notice period and go, so I decided to serve the notice period. I explained my problem to the new company's HR team, as they are not providing the offer letter without the relieving letter. They requested me to provide a letter of acceptance of resignation from my company, but my current company is not giving it, stating that there is no such provision. What should I do? Please help me.

The best way is to talk and convince your manager to approve your resignation. Also, talk to your prospective employer about the situation at work. Immediate joining can be pushed to a month's notice once you can convince.

Thank you for your reply, Mr. Namber. I tried my best to convince the prospective employer to push my joining to next month, but they didn't accept. My current employer is also not accepting this request, so I have decided to give my notice period and search for another job. Is this the right decision? Please guide me.

Convincing is the best policy. Optionally, considering that if the new employer is so keen to take you on board, they may suggest a solution as well. Just discuss in detail. In corporate settings, it is seen that a new employer who finds potential talent may help you come out of such problems. Suggest trying to convince both sides.

How have you resigned without a written offer letter. What if the prospective employer decides not to hire you after you ate relieved from the current company?

Your current company has to acknowledge your resignation, whether accepted or not. They have to send you a written communication. Until your resignation is accepted, you are not in the notice period. The notice period starts once the resignation is accepted, to the best of my knowledge.
