I have query regarding the maternity benefit of ESI Exempted Staff.Whether she eligible for Maternity benefit.I know she is not eligible for maternity benefit under ESI Act 1948.Does the company needs to pay salary for the maternity period.If yes do we need to pay the whole salary like (Basic,HRA,TA).Also we need to deduct the PF Contribution.Expecting valuable reply from you all

The ESI Exempted staff is not eligible to get the Maternity benefits provided under ESI Act.
But you cannot deny the Salary for the Maternity Leave Period, PF Contribution and other benefits as per The Maternity Benefits Act, 1961.
Please note that ESI Act is entirely different from Maternity Benefits Act.
