Hi Priya,

Despite some genuine aberrations pointed out by Shri Sajid Ansari, you have made a commendable effort in preparing this presentation for all. Keep up your efforts. God bless you.

Hi Priya,

Good job! However, you could have made an even better presentation by including the Public Utility Services (First Schedule) in The Industrial Disputes Act, 1947, which is a very important aspect of this Act. In the Employees' State Insurance Act, 1948, the applicability of the Act for employees is Rs. 10,000 per month (Gross Salary).

For labor laws, please refer to the books of H.L. Kumar and P.L. Mullick.

Could you please explain how the age factor is calculated? For example, you mentioned that for age 16, the factor is 228.54. How was this value derived? Is there a specific formula for this calculation?

Hi Priyadarshini,

This is a very good effort. The pains undertaken can be seen from the methodology used in disseminating so much info. Repeated readings will surely help you fine-tune this wonderful effort.

A couple of suggestions that could be added either in the Employer's responsibility or elsewhere are to ensure the maintenance of a congenial work atmosphere and the prevention of sexual harassment.

Think about it.

Hi, Mr. Sajid,

Thank you for your comments. As I mentioned in that PowerPoint presentation, I have compiled this information from a book titled "Elements of Mercantile Law by (2007)." The same words are used in that book. There may have been a lot of changes happening after this book was written, and I will rectify the errors and enhance the material in future versions.

I'm encountering an error after clicking the link Global Overseas: BFSI Audit, third-party audit & compliance consultant, "We are facing a technical problem, please visit later." My email id is priyadharshini.nallaswamy@gmail.com. Kindly send your free study materials and reference PowerPoint presentation so that I can further enhance my knowledge.

Dear Maha,

As of now, I could not find any specific formula for determining this relevant age factor value. But I can explain the logic behind it. This factor value decreases as age increases, indicating that earning potential and the number of years until retirement are decreasing with age.

For ages up to:
16 - the relevant factor is 228.54
17 - 227.49
18 - 226.38
19 - 225.22
...
30 - 207.98
...
40 - 184.17
...
50 - 153.09
...
60 - 117.41

And so on until 65 or older - 99.37.

This information is provided in the book. I will find and share more details with you in the future, and others may also assist us in this matter.

This is enshrined in the Act itself; hence, there is no question for any formula or calculations. While framing this Act, the lawmakers must have consulted experts in this area like insurance actuaries. Just for information, it is based on the "earning capacity" of an individual throughout his life; therefore, a younger person has a whole life to earn, hence a higher value; and vice versa for an older person.

Hope I have been able to clarify the doubts.

Regards.

Hi, dear,

I want to add one more thing that was mentioned in this presentation. On slide number 32, there is a mention of admin charges in the employer's share of contribution, i.e., 1.16%. However, based on my knowledge, admin charges are to be paid on ESI contributions.

Kindly check.

Otherwise, it is a very good compilation of rules and regulations.
