I would like to seek your guidance regarding an issue of unfair termination. One of my colleagues has been dismissed from his job without any prior notice. The HR conducted an unjust investigation and accused him of misconduct.
Furthermore, the company has not provided him with:
Notice period pay
Severance package
Gratuity amount
Bonus
Leave encashment
I would appreciate your advice on the appropriate steps to take to either claim the rightful compensation or explore the possibility of reinstating his position.
Looking forward to your guidance.

Dear member,
You have written about the unfair termination of your friend. However, the following questions arise from your post:
a) What was the designation of your friend? How many subordinates reported to him?
b) Has your friend provided you with complete information? Are you sure that he has not withheld some information from you?
c) Your friend has been terminated without providing the termination benefits. But why? He has blamed his HR for accusing him of the unjust investigation. What was the misconduct? Has he been charged with fraud or embezzlement? Did you try to find out why the company has shown such extreme strictness with him?
d) Is your friend only the terminated employee or few others are also there? If yes, how many others were terminated and what was their role?
e) When the investigation was in progress, what role did his manager play? Did he/she come to your friend's rescue?
Final comments: - Please note that we the members of this forum are outsiders and observe the incidents or situations neutrally. We analyse each case dispassionately. If your friend has been terminated unfairly, then be assured that this forum will provide you with proper guidance. However, it is risky to provide solutions with incomplete information. Hence the above questions.
Thanks,
