I have an employee who wants a two-month break for some personal reasons. The management has also decided to grant him this break, but they do not want to pay the salary or deduct any statutory deductions. Is there any advice on how we can provide him with a letter stating these conditions? Are there any legal ways to address this?

Sabbatical leave can be paid, unpaid, or without pay entirely. During the unpaid sabbatical leave, the employee's pension and other benefits would be frozen for the sabbatical period. Ask him to submit an application for sabbatical leave or simply take leave without pay for two months. In either case, the sanction order shall include all such particulars.

Sabbatical leave is generally granted in universities to members of the teaching faculty as well as in research institutions to scientists to pursue higher studies or conduct research independently elsewhere in cognate fields without severing the employer-employee relationship, with or without salary depending on the purpose. Nowadays, some MNCs also include sabbatical leave in their leave policy so that key employees do not leave but instead rejoin with better knowledge and new ideas that can contribute to the growth of their business.
If such provisions exist in your organization, you can incorporate sabbaticals into your leave policy. If not, you may grant leave without pay upon written request from the concerned employee. When there is no salary, there are no deductions as well. However, the period of such authorized absence will be considered only for the computation of continuous service.
