Dear Team,

I was working with XYZ Company for 5 years. I got an opportunity from one of the MNCs, and they wanted me to join in 15 days. I convinced the new company, but they had a very urgent requirement. I spoke with the current company's CMD regarding the same, handed in my resignation letter on the day, and requested him to relieve me in 15 days. As it was not possible due to my higher position, he agreed but asked for a replacement for my position through my reference.

I scheduled around 10 to 12 HR interviews, but the company had a 3-year bond, and the candidates were unwilling to submit their original certificates. I extended my joining date for one week after requesting the new company, and I managed to find suitable candidates by my last working day. Since this new opportunity meant a lot to me in terms of growth, I decided to leave the company after serving 20 days instead of the required 2 months notice period. However, my CMD insisted on me paying the full 2 months' gross salary for the notice period, and I complied.

After my CMD went out of station for a week, it was promised that I would receive my Full and Final settlement, Gratuity, and PF upon his return. It has now been four months, and they keep saying that I will receive it tomorrow or after CMD's approval.

I have lost my patience now. Despite my good past history, performance, and relationships with everyone, I have yet to receive my dues, which are significant and crucial for me.

Hi,

Please have more patience as you wouldn't want your efforts in the work to go to waste by acting in haste, especially in your response at this stage. Write a polite reminder to the HR with a cc to the CMD stating your position and how you have been waiting to get the clearance all these days. Express your respect for the culture and the employees. Do not hint at your frustrations in the note/email but mark it as a reminder.

Check for a week to 10 days and follow up with a second reminder without letting emotions take over.

If after a couple of weeks there is no progress, you may consider calling the CMD to inquire about the delay in clearing the dues.

Injustice Anywhere is a Threat to Justice Everywhere, and every law-compliant employer/management must keep that in mind and obey the laws of the land faithfully and properly. Full and final settlement is a natural process, and no special sanction needs to be obtained from anyone. The service rules/standard operating procedures (SOPs) should only be obediently adhered to.

Delay beyond two working days is unacceptable and hence unlawful.
