Dear Guidance Seeker,

Every employer is now legally liable and responsible to provide protection to women from sexual harassment at the workplace and create a safe and secure work environment where no woman shall be subjected to sexual harassment.

Employers' duties have been spelled out in Section 19 of the SHWW Act 2013, which is applicable to every establishment or institution.

Stringent penalties are levied on those who defy or violate the statutory provisions of the said Act, including fines and/or cancellation of the factory license or establishment certificate.

One of the ten duties of the employer is to frame a policy in alignment with the statutory provisions and notify the same for compliance by all employees and others.

Scripting the text of the policy is a specialized job; you may seek help from subject matter experts like the Kritarth Team.

The Kritarth Team has specialized educators as defined under the said Act who have helped numerous companies and management in full-scale compliance with all the mandatory provisions of the Act, such as:

1. Conducting mandatory twin (two) programs for the ICC members, namely i) Orientation Program and ii) Capacity & Skills Building Program.
2. Conducting mandatory awareness programs for all employees of the establishment at regular intervals to sensitize them to gender issues and inform them about the provisions of the Act.
3. Serving as the ICC Member (External).

Additionally, the Kritarth Team provides:
- Written guidelines for ICC members' effective functioning.
- Conducts train-the-trainer workshops for HODs and HR/ER departments to enable them to conduct programs in the future.

There is enough information available on Prevention Of Sexual Harassment (POSH) Policy. If you google, you will find ones that have been created by large companies and listed for public information.
