1. What can be an email or undertaking from the employee to show their awareness of the sexual harassment policy of PE at the time of joining any organization?

2. What can we, as a Delhi-based HR company with more than 100 internal employees, including 50 female staff, do under the sexual harassment policy to prevent any legal issues in the future?

3. Are there any annual return formats required, and where should they be submitted? Is this a requirement under labor law or civil law?

As per The Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013, it is mandatory for every workplace with 10 or more employees to have an Internal Complaints Committee (ICC) that would play a critical role in the prevention, prohibition, and redressal of sexual harassment in the workplace. It is your duty and legal obligation to provide training to employees on the subject. Taking email or undertaking without any training or camp is simply insufficient. You need to implement the act in your organization.

Employers who fail to comply the Act shall be punished with a fine of up to Rs. 50,000 rupees on first time and Rs. 100000/- on second time as well as cancellation of license.
