Dear All,

I need details on the below queries. Kindly help me out.

1) How long can a company hold an employee's full and final (F&F) settlement, PF amount, and experience letter? It has been more than a year, and they are not responding to my emails as well. What can I do?

2) Can a company withhold my certificate by citing background verification for almost 8 months? This company is a supplier to a Fortune 500 MNC. If so, what can I do?

Regards,
Raj

Dear [name],

Please be informed that the settlement amount is legally binding and must be paid in full within 48 hours of your departure from the company, along with the issuance of your service certificate.

It is regrettable to witness the current situation you are facing. If your case involves a managerial position, you may consider filing a lawsuit in a civil court. On the other hand, if you are categorized as a workman, the appropriate jurisdiction would be the labor court.

Best regards,

Final settlement dues, PF, etc., cannot be denied by the company. You can approach its grievance redressal cell or customer care, if existing, to get a written reply from the company regarding this matter. If they choose not to reply, you can write to the Company Law Board. Thereafter, you can approach the civil court by filing a suit against the company.
