The Supreme Court has held that compensation under the Employees' Compensation Act is payable even in the case of employee negligence. This is different from compensation under the Motor Vehicles Act, where negligence matters. A copy of the judgment dated 4.2.2016 in this regard is attached.

This is not the new finding of SC. Section 3 of the EC Act states that the employer cannot disown responsibility for paying compensation for injuries caused by negligence, provided that the injury results in death.
