I am working in the organized sector in pharma, holding the manager post. One day, two of our front managers assigned a new manager to the same headquarters which I was overseeing, without providing me notice or a termination letter, and I had not resigned from my post either. One of my superiors has stopped my salary and is holding one of my incentive cheques. How do I file a legal lawsuit? I was also not a confirmed employee but was performing well and was the number 2 in our zone. I worked for more than a year and a half in the company.

Hi Sanju,

When this company deals with you in such a manner, why do you hesitate to leave? It is a strategy to make you tender your resignation voluntarily. My suggestion is to tender your resignation and request to process relieving papers. Try not to get into a debate with management. Get your papers and find a good job elsewhere. As you are good at your work, you are going to find a suitable opportunity ASAP. Wishing you the very best!!!

1. Start searching for another option.
2. Discuss directly with your boss and ensure a smooth departure only if he releases your salary and payments.
3. Write a detailed email to your HR and ask them for the reason for holding the salary. They have no right to withhold salary just because employees don't register protests; such practices are increasing in the industry.
4. Tell your HR that you have the courage to face the consequences.
5. Document all your performance and register the same with your HR and management.

Dear Sanju,

The legal position regarding your case is that you cannot approach the Labour Court. You will have to go to the Civil Court to get your rightful dues. The terms and conditions mentioned in your appointment letter govern your employment. If it has the provision of providing the Notice Period pay before termination, you can recover the same from the company. In my opinion, get the help of an Advocate and send a legal notice to your employer. Based on my experience, most cases get settled upon receiving a legal notice.

Also, as suggested by the worthy members above, please start looking for another job. Please share the details of your appointment to enable members to provide you with better advice.

The management has the right to appoint anybody to any position or transfer anybody to any location. You cannot question this. If this situation occurs, you can only seek clarification from HR. It may be better to search for a job elsewhere. Speak to HR to inquire about your salary, which is your legal right. Once you receive your salary and a relieving letter, you can join another company and find happiness. All the very best.
