An employee can take annual leave during a notice period if the employer agrees to the leave. However, the employee can only take personal or sick leave during a notice period if they give:
- Notice of the leave as soon as possible
- Evidence if the employer asks for it (e.g., medical certificate)
An employer cannot force an employee to take leave as part of the notice period.

The provision of a notice period has a practical purpose. Firstly, it allows sufficient time to find a replacement, and secondly, it enables the completion of all important tasks at hand. With this purpose in mind, any policy regarding leave during the notice period should aim to discourage taking any leave except in exceptional circumstances beyond the control of the employee. Even then, no extended period of leave should be permitted.
During the notice period, the employee must maintain uninterrupted performance by attending the office/work for the full notice period, and the policy should discourage any absences.
