Hi,
I have resigned the present company for a better Job profile, better salary. In the current company i have to serve a notice period of 2 months and i can't serve beyond 1 month. i am ready to give a month's salary. But the current company isn't ready to relieve me before the notice period.
They have accepted my resignation which is in the email format.
Could you please help me how to deal with this?
Regards,

Actually you have no choice.
I am not sure why they want to hold an 'unwilling' employee as we do not expect the same output once the employee submits the resignation.
You may think of talking to the boss at the current company and request for earlier release.
You have a better ground if you have completed the current assignment and work will not suffer due to your non-availability. Else the company needs to recruit another person in your place and the company's decision is justified.
You must talk to the other company if they can consider your joining after a month. Also tell them frankly what happened. However it is a tricky issue as no company would like to hire an employee who is already on another company payroll. Lot of issues regarding PF etc may also arise.
You can not hide the fact of reliving date with new company as one day or other they will see the letter and you will land up in an awkward position.
Think over and convince atleast one of the companies.
All the best

Thanks for your reply.
I resigned cos i was unhappy with teh work and even after several pleadings the management didn't give me a change. And i was forced to do something which i am not interested at all.
Now they say its company's policy to serve a 2 month notice period and my future company wants me to join on teh given joining date.

hi V
dont worry, see in this situation you have apparently two choices, the old company wants you for 2 months, the new co. want you in 1 month, talk to the old co. boss, the upper level management about your prob of non-availability and assure them that you will try to do all pending work assignments in 1 month, even dont take day offs during the 1 month, & on the other hand try convincing your new co. boss and smoothly tell them your availability can be within more than a month,as you have resigned from your old co. and care enough to join them then they should wait for another month as well and they can have you for the rest of months
n if they dont understand still dont worry, the wolrd is also not so big but not too small, you are talented and that's why this new co. hired you, so cheer up
all the best

Hi to my understanding, the employee who are on probation period, are requested to give a one month notice. If not then they will have to pay amount as per the notice period (i.e. on the basis of his basic salary) , Else, if an employee is an confirmed employee, it is applicable till 3 months of notice period.
Actually this depands on the company rules and regulation. The normal situation to deal with this issue is to talk to your boss. Give an genuine reason as why you want to leave the organization. Complete your task required to complete and do the exit interview with your HR manager.
Hope it is clear. Any further doubts let me also know about this.
thanks
