Dear All,
under section 3 of the National festival holidays Act 1963 every employees shall be allowed in each calander year a holidya of one whole day on the 26th January, 15th August, and 2nd October.
Now my query is that shall employer can keep open the establishment in the aforesaid holidays ? Pl clarify.

Hi ,
Employer can keep his establishments open on the national and festival holidays as closing of the establishment may bring down productivity of the establishment which is crucial
But the employers obligation is to pay double the wages to the employees who works on national and festival holidays.

First of all you must get exemption under the Factories Act of the area which require continuous process/activities. You will have to pay double of the wages and one holiday for working on 26th/2nd/15th National Holidays only
