Hi Friends,
I need urgent advise from your guys!
The thing is that i want to leave my job urgently but as per the appointment letter, i have to serve one month notice period or give one month salary thereof, i do not have any issue in it but if i choose to serve one month notice period,i will have to wash off my new job
so just wanted to know one thing, can i use my casual leaves, Sick leaves and Annual leaves to get added in my notice period, and if yes how and to what extent, please guide me on this

Normally companies do not allow one to avail his leaves during the notice period. But in exceptional cases company should give leave because just because the employee is in notice period one can not refuse any leave. However, if your intention is to join another company and exhaust the leaves in the past company to the extend possible and get relived, there is a problem. Suppose if you put paper today, ie, 18th June and you join new company on 20th June taking leave from the previous company from 20th onwards. On 17th July you are expected to be relived from the past company for that you have to take leave from the new company and come to previous company and do all relieving formalities and collect your relieving cum service certificate which will say that ".....has worked in this organisation from (date of joining) to 17th July 2011". In your profile, the date of joining the present establishment will be 20th June whereas your just previous employment will be from ...(date of joining) till 17th July 2011, with an overlapping of one month service!!!

That will create problem when you transfer your PF also. Contributions at the previous company will be worked out till 17th July and your name will appear in the form 10 (return of employees leaving the company) of August 2011 only whereas in the new company's form 5 it will come in July 2011.

Therefore, availing leaves to utilise notice period in new company will not be recommended from my side unless and otherwise your present company permits you to compensate the notice period by way of leaves available to you for encashment or otherwise.

Thts really good PON that you have noticed this and make him answerable which is really important..even i dont understand why people do this while they also can get the things by searching as there are numbers of discussion on the same topic and numbers os peoples have put participated several times..one can get the answer easily if want but still peoples are not understanding this and also doing the same like "destinywins" have done here...multiple post..Wanna offer my thanks to you PON

Your destiny does not win, if you are not following the principles of natural justice.
NP is meant for smooth transition, which I have been Time & again reiterating with respect to find out out a suitable alternative. If you avail all the accumulated leaves in lieu of NP, how you are going to serve the purpose of N.P?. Intropection is needed.

Hi Destiny,
You should have smooth exit from company world is too small and you can meet same people again. Whether leaves can be added into notice period? it depend open company polices. If your company have such policy, your manager and HR don't have any issue then you can go for it. As professional we should insure that we give full and proper handover and nice good bye!
