Hi All, I just want to get it clarified if ESI is applicable or NOT for STPI registered NON-IT Company. As all employees are covered under Mediclaim insurance policy. Thanks Pallavi

Dear Ms. Pallavi ji, The STPI is covered under PF & ESI as per the act. Before that weather your etablishment is registered under shops and estb.Act ? If so its automatically covered. For PF cealign limt is Rs6500/-(See the act) and ESI Rs.10000/-. For Provident Fund ,if any employee cross the limt he will be called as exempted employee. Regarding ESI if any employee is cross Rs. 10,000/- you need not cover it. Further clarification please go through the act. Regards, PBS KUMAR

as far as i know if ESIC will be applicable den S & E act wont be applicable - Section 38-C of the Bombay Shops and Establishments Act as well as the proviso to sub-section (1) of Section 2 of the Maternity Benefit Act give power to the State Government to extend the application of the Maternity Benefit Act to women employees in any establishment or class of establishments. Accordingly the State Government has extended the application of the Maternity Benefit Act to all shops, commercial establishments, residential hotels, restaurants and eating houses to which the Bombay Shops and Establishments Act applies but the Employees' State Insurance Act does not apply.

Hi Pallavi, Before going for the ESI & PF regd 1st you have to see the size of your company w.r.t. no of employees those who are on the roll of your company. Since its a IT company & if your company is having 10 or more than 10 employees then you have to go for the ESI & PF regd. There are some other regd certificate also you have to take depends on the prsence & existance of your comp i.e. on which state your comp has been esttablished. For the formalities of regd & relevant forms both for ESI & PF you can go through the act which is available in the net. You may access it through google also. Regards Sidharth

Coverage of ESI is not necessarily on the basis of the nature of industry as Software or engineering but it is on the basis whether the establishment is set up in an area notified as covered or not. There are areas notified as not covered by ESI. Therefore, the first thing to be ensured is that whether any exemption is available to the respective area where the park is set up. If it is exempted area, then all firms in that area, irrespective of software or not, will be exempted from the ESI. For EPF no such exemption on the basis of area of operation will be available. All firms which employ not less than 20 employees will be covered by EPF. The question of whether or not employees' salary does not exceed Rs 6500 comes next only. For EPF, although employees whose salary exceeds Rs 6500 are excluded,the establishment will be covered. Dear Drupad, You may interpret the Maternity Benefit Act as applicable to all establishments to which Shops and Establishments Act (as also the Factories or Plantations Labour Act) applies but does not apply to employees (women) to whom the ESI Act applies or who is covered by ESI. It does not means that the Maternity Benefit Act will not be applicable to employees of the establishment to which ESI Act applies. But it only implies that the benefits under Maternity Benefit Act will be available only to those women employees who are not geting maternity benefits from the ESI Corporation under the ESI Act.
