My query is that suppose a RH or a Fixed Holiday (like Independence day) falls on a Sunday or Saturday (weekly off), is it mandatory to give a compensatory off? We are a design firm based in NOIDA.

Dear Member,
Certain State having separate statutory provision for National & Festival Holidays. Under this Act, 4 National and 6 Festival Holidays are mandatory. If any holiday falls on weekly holiday. The mangement can sustitute some other holiday for the benefit of employee.

As per Shop and Establishment act, any industries have to provide minimum 9 holidays. In that 4 national compulsory holiday and remaining 5 can be national festival or local festival, as per ur company head decision. if 2 national holiday coming in week and 2 on sundays, then u can extend your festival holiday to 7 days. I think you can understand right now.

NATIONAL AND FESTIVAL HOLIDAYS DURING 2010
Reulation with regard to grant of paid holidays to employees is governed by karnataka industrial Establishment( National & Festival Holidays) act 1963. The minimum number of holidays provided as per amended Sec.3 of the act is "TEN" days in a calender year of which 26th January, 15th August, 2nd October, 1st May day, & 1st November are compulsory. Hovewer, compulsory declaration of holidays on May day and Kannada Rajyotsava are not obligatory for Central Public Sector Undertakings, who need to observe minimum eight paid hoildays in a caleder year.
If any of the compulsory Holidays fall on the Holiday even then same has to be declared as Paid Holiday, as in the case of these holidays "substitution" does not arise.
