Dear Seniors,

I am working with a software firm for last one and half year, I am the only person to handle the HR dept here, My Md is also pleased with my performance. Recently I got an opportunity to move to a manufacturing industry, as i am interested to explore the different verticals of the HR domain so i accepted the offer, this requirement is very urgent and the company wanted me to join ASAP, So I seek 9 working days time to join, though my present company has the policy to give a one month's notice period. When I submitted my resignation to my MD, he told me that as i am not giving one months notice period so he will not relieve me, neither he will accept my resignation.

Please suggest what should i do in such a situation, as there is no body in the HR dept so I cant submit my resignation to the other person, Though I am trying to find a replacement of mine, but I am not sure whether it will be done by this time, as MD may not be willing to take a new candidate with a higher salary.

All the discussion with my MD in mail, can I submit this mail as a proof of my resignation, or should I asked my prospective employer to increase the joining time which they may not willing to agree.

This is an urgent dicission which i need to take ASAP preferable by today itself. Please help me....

Dear Manas,
If your present Company insist on a Release Letter nothing can be done, and it was your mistake to commit to them that you can join before your Notice Period. The Employer can ask you to serve the Notice Period which is absolutely logical and reasonable(Moreover, in your case it is more because you are the lone person).
Now, if you want to abandon the job, then sent your Regisnation through Registred with A/D, but in this case you will not get release letter and if you accrued Dues are less than the payment you need to make your Company due to short notice period, then you Current Company, if it wishes can bar you for taking up new job and compel you to pay the deficit.
The best thing would be to talk with your MD and try convinving him. In the meantime carry on with your search for a replacement.

Dear Swastik,
Thanks a lot for your valuable suggestion, Will a talk with the prospective employer to increase the joining time results in a negetive perception on my employment ??, They have asked for the resignation acceptance right now and the relieving have to produce later.

Dear Manas,
No, a sensible Company will understand your problems, but it was mistake on your part to make a commitment.
Look, if they insist on release letter you will have to convince your MD. Like, if you join now by the method I said(Registered A/D), they will allow you to join but your MD will not give you the Release Letter. So, if Release letter is a compulsory and essential part then the only way out is to convince your MD.
