I have been with an IT MNC for the last 4 years, and now I have joined the government organization. There is an overlap of 2 days between the last IT MNC and the current government employer. The last date in the IT MNC was 01-Oct-2020, and the date of joining in the government organization was 29-Sep-2020. I have paid a penalty amount to my previous employer for a shortfall of the notice period for the period of 01-Oct-2020 to 20-Nov-2020. In the release letter, my last date of service is mentioned as 01-Oct-2020. Since the previous employer was a private firm, the current government employer informed me that it is not necessary to submit a release letter. My question is, will this cause any problems in the future?

I don't think you'll have any problem, especially since you had a buy-out until you were relieved on 20.11.20 and didn't earn a salary until 1.10.20 from the MNC. The overlapping should not cause any issues. Having already received your release letter and if your present employer doesn't insist on the very same letter, there is no need to worry, I guess. If they do require the letter as part of their procedure at some point, you may submit it when asked. Any overlapping or dual employment could lead to difficulties if someone receives a salary for the same days from more than one employer. If you have not yet submitted the joining report to your present employer, you may attach a copy of the relieving letter for their records.

Thank you for your reply. I have buy-out from 01-Oct-2020 to 20-Nov-2020. I have joined current org on 29-Sep-2020. This is where the confusion arises.

Can anyone please help me to clear my confusion? I had a buyout from 01-Oct-2020 to 20-Nov-2020 (51 days); however, they have paid me the salary for the full month of September. On the other hand, I have joined a government organization on 29-Sep-2020. So, will this 2-day overlap cause any problems?

What is the issue, when your controlling officer has clarified that no release letter is required in joining the new post? Obviously, you have already joined. Let the past be past.

Dear friend,

In any case, you have to refund the emoluments received for the days overlapped in order to avoid complications like 'unjust enrichment'. You cannot receive a salary from two employers for the same days.
