Sir,
I was working in a Mumbai based construction company at Delhi since October, 2009. I resigned from
company in October, 2016 by giving one month notice as per rule/regulation of the company. The company
has issued NOC subsequently. The company has deducted provident fund and gratuity from my salary for the
entire period, which is also reflected in my salary slip, however, the company has not deposited the PF
in my EPFO account for the period from October 2014 to October 2016. Secondly, the company has not
released my gratuity yet. Thirdly, the company is also not releasing my salary for the month of September
and October 2016. I have sent a number of reminders through email and post to the company, but to no
avail. Kindly suggest me way to get my PF, Gratuity and salary from the company.

Dear Amit,
What has happened with you is unfortunate. We will suggest you the remedy however, first confirm whether you have been issued with service-cum-employment certificate.
Not depositing the PF is illegal. Therefore, you may approach the PF office of your area and give a formal complaint. Take with you copy of salary slip and all other evidence of your employment with the company.
For non-payment of gratuity and salary you may approach the labour officer of your area and give a formal complaint. Take with you copy of salary slip and all other evidence of your employment with the company.

Please Clarify about your Statement of "Company has deducted Provident Fund & GRATUITY From My Salary for the entire period? Gratuity is paid from Employer based on your length of Service based on your lat drawn Basic+DA+VDA
Please submit your gratuity Claim to your Employer.If you do not receive Payment approach Controlling Authority/Assistant Labour Commissioner.You are liable to get interest @12% for belated Payment of Gratuity.
