I am working in TCS for past 2.5 years and now my project got over and I am transferred to new project on June 03,2013. But I got bank job on July 01, 2013 and since i am not yet trained in my new process i want to pay my notice period and want to join in bank job. But my project manager is not accepting me to pay and instead he want me to serve my 3 month notice period. If I serve for 3 month then i will lose my bank job. I have escalated this to my HR and they are trying their best to relieve me but now they too not sure to relieve me. Now i am sitting ideally in my office and fearing about not getting my bank job. This creates mental pressure to me. Please help me to solve this issue.

If terms of your employment (appointment letter) has provison for Three Months Notice, it will be voluntary on part of employer to accept the Notice Pay. You should have mentioned the same to new employer that you need three months time to join.
Now you can request the Bank for additonal one month time and can request TCS manager that since you insist I will mnage to engage one more month with TCS.

Compliance with the 'Relieving Process' of an organization, where you work, MUST be kept in mind while accepting a new job - this will be my message to all youngsters working in any organization, big or small. Two points to be remembered are (i) your company can pursue legal action against you (ii) you cannot think only of your benefits & growth in life, your company must always come first. If you follow this approach, you will always be successful in life.
Just projecting your problem on CiteHR, and expecting others to provide solutions, does not carry the requisite wisdom. Some may console you & others may suggest approaches which are already known to you; you are gaining nothing. There may even be people to misguide you, who wangled out of similar situations themselves.
I shall advice you to take your own decisions, keeping the above realities in view. This is to enable you to live on your own strengths, which you do have in plenty, but which you are denying to utilize.

I am always sincere for my company. Some time situation may push us because of family situation. Since i don't have any work I approached for to pay my notice period. But most of the time organisation fails to understand their employee situation.

Leave your current organization in result what happen?, they will ask for notice pay after few months.
As mentioned you are ready to pay the Notice pay than whats the problem.
At time of Joining to new organization; inform them about the situation so in future you do not have to face the problem.
All the system always made for employees, use the system.

I have few confusions which need clarity before giving any suggestion
1) You told that you got a bank job, for which you must have cleared few exams if I am not wrong, so you were aware of getting a job in advance.
2) Bank must have given some time limit to join which will not be less than a month, if so you would have resigned earlier and give some notice instead of 3 months
3) What is your Termination Clause/Notice Period Clause as per Appointment Letter, please let the forum know to give appropriate answer accordingly
4) You mentioned that you were supposed to join Bank on July 1, 2013 which means it was a fortnight back and you have not joined till date, which indirectly states that the Bank is willing to wait further
5) You have not mentioned that TCS has accepted your resignation or not
Please clarify the above points so as to suggest you further steps

If you need a 'finger', ask for a 'hand', & after negotiations, you will get the 'finger'. If you ask for the finger in first place, then you will get nothing but empty speaches.
Unfortunately, this is how the 'compnay management' works.
If you abscond, & refuse to pay or serve for the period, then they would definitely settle for payment of 3 months. Management likes to see that settlement is done from their side. If you try to settle from your side by suggesting to pay for 3 month's pay amount, it would not be accepted.
Morally, I do not appreciate Ashish's (Ashvan.2927) view, but practically, I completely agree with his response. If you are planning to resign the job, be prapered to face these adversities & act accordingly, whether you feel it right or wrong. Just throughout the process, keep your head cool & don't take this as a 'fight' against the employer. Consider it as a 'negotiation'.

1) Yes i am aware but not sure about whether i will get job. Because bank will not announce their result immediately. I attend interview on May month buy i got offer letter on July.
2) Yes bank has given me time of one month. So I resigned my job on July 1st immediately i got offer letter.
3) As per appointment letter i have to serve for 3 months or I can pay my notice period but for that my production manager has to approve.
4) No Bank has given me time till Aug 1st
5)TCS has accepted my resignation but not allowing me to pay my notice period.
If i serve my 3 months notice period then i will lose my both tcs job and bank job. I am only salary person in my family. Next month i am going to get my fist baby. If i get bank job then it will be usefull for my whole family and i can close my loans.

If that be the case you should have been on maternity leave now
Even if they relive you, how can you join on 1st of August 2013? No orgnaisation will allow a person to join within 6 weeks of delivering a child.
Generally no new projects will be assigned when a female employee is in advanced stage of pregnancy and as long as your salary is not reduced, you can not complain about it
Probably there are more facts in this case than what you have highlighted so far
