Dear All,

This post is relates to Security Guard board Exemption.

We had been deployed 4 security guards hired from one Private Agency. We, as principal employer are satisfied with the services as committed, part of statutory compliance & all documentation are well maintained by Agency. Only the point was "EXEMPTION".

Recently, Two inspectors from Security Guard Board has visited our office for inspection. When we met inspectors, they pointed out that exemption is needed even if there are 4 security guards deployed, which your private agency has not been fulfilled & levy has not been paid by their end. They want Clarification,else they will raise notice to Our company.

Last year, in the same case of 4 guard, it had advised to Private Agency from one of Security Guard Board Inspector that " for opting Exemption, minimum 20 guards has to be deployed in one unit.Further,Private Agency has not initiated the consent letter for opting exemption because of less number of Security guards.

In Fact,There is no scope for 20 Guards in our small unit.

What has to be done in this case?

Don't you think this is misleading?

What is real situation? From Whom ,we get clear cut idea. Can we get notification of Security Guard Board?

There is no minimum number for exemption from security guard board

Dear Madan ,
In Maharashtra There is a board ,under Labour Dept, to Inspect any Premises to ensured that there is no Private Security is engaged .If at all if there is than they have taken exemption .
Dear you info Security Contractor ro solve this issue with Inspector .They will do it .Dont worry .

This is under the Maharashtra guard board act.
It was the first state to put regulations for security guards.
Anyone employing security guards is required to hire directly, permanent employees or hire from the guard board.
If contract security is used, they must have an exemption from the guard board and must give equal or better terms to the employees. The exemptions are specific to each factory, and the names of security guards are also specified in the notification.
The act is responsible for improvement of security guard salaries from below subsistence to decent in Maharashtra and was model for the Private Security Agency Regulation Act of the Center made later.

Where exactly is your unit/factory located??
To my knowledge this scheme of Guard board is applicable only in Greater Mumbai and Thane District.

No nathrao, The scheme is in many other parts of Maharashtra, including nashik, Aurangabad. It started with Mumbai and thane

Dear Sir,
Can You please provide Notification to support this for my reference..
It mean We should initiate the process for Exemption even if we have 1 security guard hired from Private Security Agency.

We have informed to handle this matter to our Security Agency only and they have 'managed' the matter.
But as a principal employer, should we start the exemption procedure through Security contractor as we have 4 security Guards?

Dear Friend ,
It is long and lengthy procedure .Only certain Institutions are exempted cunder the Act .You ask Local Asst Labour Commissioner Office they will guide you Akso ask Security Agency they will help you .Normally all Securiy Agencies with Labour Dept . they help the Clieny .
