I am working in a court in Gujarat. I am working as a clerk in the court as a permanent employee. I got a job in Indian Overseas Bank as a clerk. When I had applied and got an interview call for the bank, I intimated my department and got an NOC for the interview purpose. Now, I am selected in the bank and want to join the bank. Do I have to pay the notice period pay, or can I resign immediately without paying the notice pay because of the NOC? One more thing, can I keep a lien for changing the job for 6 months or 1 year?
Please help me out as I am very confused.

You have already taken prior permission from the State Government. Now you can't keep your legs in both jobs. You have to decide yourself as to how to shape your career. In my opinion, as a young person, you are not satisfied with the environment in a government job. But give thought to your future. Nowadays, the banking job is becoming a risky one, and you may also have to do marketing work in a banking job. Yes, today's banking atmosphere looks very appealing to customers as they have all the facilities like a neat & clean office with A.C.

You can't have your cake and eat it too. The moment you quit job number 1, that option is closed. So, think about all angles, aspects, discuss with well-wishers, friends, in court, or at the bank, and then decide.

As far as I know, a government employee can join another position while retaining their lien over their previous post for one year, i.e., while obtaining Leave without Pay. All information must be provided to the employer when obtaining such leave. However, when it comes to serving the notice period, the same requirement remains, and you must either serve it or buy it out.
Therefore, please confirm with your department before making any decisions.

You need not follow the due procedure for resigning. Please verify your appointment letter. Since this cannot be a technical resignation, you cannot keep the LIEN.

As you have already secured a No Objection Certificate (NOC) for the banking job, all you need to do is resign from your current position by stating the reason. You must wait for the acceptance of your resignation and the issuance of relieving orders.
