Dear sir, Due to annual increment if an employee comes out from the ESIC ceiling and contributed up to Sep, she will get the same benefits up to which period aand whether she is entitled to Maternity benefits even after the contribution period?

Hi,

If the Member is contributing to ESI at the time of proceeding on maternity leave she will continue to enjoy the benefit irrespective of hike beyond ESI ceiling.

All insured female employees who have made contributions towards the ESI fund for a minimum of 70 days are eligible for 100% of their average daily wages for a period of 26 weeks in confinement, 6 weeks in case of a miscarriage, and 12 weeks for commissioning or adoption.


Maternity benefit will not be applicable if the member is out of ESI limit totally.
