Hope all are fine.

As mentioned in the subject, there are limited changes in the ESIC Act. Notification dated 06.10.2016 for an Increase in ESIC Limit from Rs. 15,000 to Rs. 21,000. The Employees' State Insurance Corporation (ESIC) raised the monthly wage threshold to Rs. 21,000, from the current Rs. 15,000, for coverage under its health insurance scheme.

    October 10, 2016

    Ministry of Labour and Employment has introduced new gazette notification to increase ESI maternity leave to 24 weeks from 12 weeks by introducing Employees’ State Insurance (Central) Amendment Rules, 2016.

    According to the new gazette proposal, after its final approval women with following category will also be eligible for ESI maternity benefits:

    a commissioning mother who as biological mother wishes to have a child and prefers to get embryo implanted in any other woman;

    a woman who legally adopts a child of upto three months of age;

    The Objections or suggestions, which may be received from any person in respect of these draft rules within 30 days from the date of publication of this Draft Rules, will be considered by the Central Government.

    Objections and suggestions, if any, may be addressed to Shri Ajay Malik, Under Secretary, Ministry of Labour and Employment, Shram Shakti Bhawan, Rafi Marg, New Delhi-110001.

  • In my last thread, I had raised the question of the rule of allotment of an Insurance Number within ten days. If the notification is enforced from October 1, 2016, it would be a breach of the law. Currently, the notification has not yet been enforced, so we can't obtain the Insurance number. Should we assign Insurance numbers to those individuals who are expected to become members under the scheme?

  • In our earlier gazette notifications, the enhancement of the wages limit under the ESIC legislation is prospective, not retrospective. Therefore, any gazette not published before 30.09.2016, can be treated as not implemented. You can continue to recover ESIC Contribution on Rs.15K only for the next six months.

    Notification No. F.No. S-38025/04/2010-SS-1 dated 20th April 2010, the Ministry of Labour & Employment has enhanced the ceiling to Rs. 15,000 per month w.e.f. 1st May 2010, which is reproduced below.

    Please check the last notification. It has come into force from May 1, 2016, i.e., in between the contribution period. As such, this notification may be effective from 1st December 2016 because the notification may not be issued before 5th November. Hence, it would have to be implemented from a retrospective date.

    Check the last issue for objections from the public was raised on 26.02.2010 and re-notified in the gazette in April 2010, which took effect from a prospective date, i.e., 1st May 2010. Hence, this notification may not be possible from 1st December 2016.
