Now, the question is how this unorganized sector is going to comply with this. To date, the PF scheme has not been fully implemented by this sector. The government is introducing new schemes, enactments, etc., but the big question remains: how many of these are actually being implemented?

Many organized and big corporates are complying with all or at least most of the labor enactments. Instead of announcing new or amending the existing laws, the government should implement the existing laws and try to recover crores of dues outstanding for many years from several employers. Senior/top officials should be given targets, and periodic reviews should be done. As you rightly mentioned, it is easier to announce new schemes or proposals, but let the authorities establish their existence first for getting employed and holding responsible positions by enforcing the existing laws.

Thanks for your contribution. EPFO has declared a special recovery drive of PF dues in August 2015. Such drives or initiatives by the department often remain on paper. These initiatives primarily benefit the authorities only.

Many establishments are paying PF on amounts like 2500 or 3500. During an audit, I encountered a contractor who insisted that this practice is acceptable. Despite the threshold limit being raised to Rs. 15000, numerous establishments have still not enrolled their employees under PF.

Many PF and ESI officers are doing consultancy. The company that appoints them is protected. Others are subjected to harassment. Also, those who follow the law are subjected to inspection and drives. Inspectors come for collecting money only.

Dear All,

Is it the right time and move by the Union Government to substitute EPF and ESI with the National Pension Scheme and Insurance Scheme? How beneficial will it be for the workers? Will the proposal be cleared by the government with the support of the unions and employers soon, so that there could be relief from the 'Inspector Raj'?

They can recover from the employer. But the authorities must give the details of beneficiaries of the recovered amount.

Dear All,

Vide order bearing No. 1471732 dated 21.09.2015 in the matter of Builders Association of India, Madurai Centre v. ESIC in WP(MD) No. 16996 of 2015 and MP(MD) No. 2 of 2015, the Madurai bench of Madras High Court has granted a stay in the operation of the impugned notification by ESIC No. P-12/11/11/60/2010 Rev. II dated 31.07.2015.
