I request for detailed clarification.
One of our member has missing since 1997 and a police complaint was preferred by his wife and subsequently they have issued a certificate that the member could not be traced. On his wife\'s claim for EPF, she was instructed to prefer claims in form 20,10Dand 5. She has applied for that, now they are insisting Civil Death Certificate and Legal Heir Certificate. The member\'s EPF Amount may be less than Rs.10000/- Since the member is poor and lone earner for her family with a girl child of age 18, she could not approach the Court of Law and Revenue Officials in this regard. She is submitting a Indemnity bond and the employer is ready to give a undertaking to the effect that the member is missing. Please help how to get the claim amount without submitting the civil death certificate and legal heir certificate as she is not afford to

Hi, I wish to mention that the civil death certificate is not necessary when there is a police certificate and an indemnity bond as mentioned by you. she can approach the EPF authorities and furnish these documents for her claim. documents like ration card or voters id etc will also prove the relation between the missing person and the person who is claiming EPF would also be necessary in this regard.

Pls go to Civil Court which will issue succession certificate on the basis of the police report & will declare dead, because considerable time has already elapsed. Pls claim successions for all properties in this claim viz bank balance etc.( not PF amount only). Here there two question to be settled, one is death of the member and second legal heirs.
