I am working as an HR Executive in a manufacturing concern. Recently, one of our production workers was involved in an accident and passed away after completing his second shift duty. I would like to know how to claim death benefits. Are there any other benefits entitled to dependents of the deceased? If so, what are these benefits? Additionally, please provide details on the required documents for the above claim and specify who needs to submit them.

Is it during the course of employment? That means, after completing the work, while going back to his residence? If so, it will be deemed to be an accident during the course of employment. The only thing to be noted is that the time and place of the accident should match the notional extension principle. As such, if the death had taken place in a place through which he usually passes to reach his residence, and at the time when he usually reaches the place after logging out from the factory, then the accident will be deemed to be an accident during the course of employment.
In this case, the employer should submit an online accident report. In the case of death during the course of employment, the nominee will receive a monthly pension. There is an immediate payment for funeral expenses, to the tune of Rs 15,000. In order to claim the funeral expense, the eldest member of the family shall apply in form 22 attested by the employer.
To receive the pension, the nominee shall submit the death certificate, location sketch of the place where the accident had taken place, and copies of FIR and mahsar. In addition to the pension under ESI, the nominee will also receive EDLI and a pension from the EPFO.
