I work as a HR in a BPO company and we would need to work on Independence Day and what document / letter that we have to get from government / TN Shop and Establishments Act to work on that day as we come under "Essential Services"
Assuming that we fail to comply or get it before the said date (Aug 15), what would be the legal implications that we would be facing.
Pls. assist so as to proceed.

Dear Swaminathan, Please declare an optional leave during the work-week for your employees to avail, incase they are working on a National Holiday.

Anyhow we are declaring an alternate day off for the employees, but just wants to understand on the legal implications that comes on Labour and welfare relations.

I believe your establishment is registered under Shop and Establishments Act. There you might have mentioned the nature of business you are engaged as essential service and off/ holidays will be observed on rotational basis.
We used to engage minimum number of employees on national holidays and we give a option to avail a leave or double the salary for the day.

If your states have saprate enactment for the "National Holidays", then you have informed in specific format to your local authority. but you have to pay overtime according to your provision mention in your state enactment.
