Hello Friends,
I would like to know is there any solution if any management is refuse to give Experience letter to me.
I m living for my better prospects and ready to give proper 1 month notice period to the company as per company rule , But they are not ready to take notice period.also not ready to give proper experience letter what shall I do?
I had spend 2 1/2 yr in the organisation, how do i prove it to another place? can I take any action aganist them?

Dear
In your post you have not mentioned whether you have submitted your resignation letter.If done the send them a letter not mail signed by you by Speed Post with POD .
In this letter you must refer and extract the notice period clause in your appointment letter and also the date of submission of your resignation ,the notice period and your intended LWD.On receipt of this notice from you they should definitely relieve you and issue an experience letter.
If no positive result comes out then you need to consult a local legal counsel.

Hi Swati

Fist you must confirm that your resignation letter has been accepted or not. If it has been accepted then you must give the proper notice period as per mentioned in the appointment letter and you should talk to your management. In spite of this they do not provide you releaving letter after giving the full notice period then you outght to consult from local leagal officer regarding same.

I had presented my resignation with the mentationing notice period in front of management but they , refused sign as "accepted".But I had Email it through my personal mail Id to Company mail ID & GM of the company (i.e. Senior HOD to me). But as they received my mail they make me to leave the job on the same day.And refused to give experienced letter to me.

In least case also you can prove your association with present employer, using your P.F A/c Num and pay slips. This information is sufficient to prove before new employer regarding your expreince & employement.
Also, be cautionate in dealing your current employer because they may claim false alligations against you. So, try solve the issue within your scope. The only thing you can do is proper handovers from your end.

Swati, it's rarely that an employer is such will deliberately spoil someones career without there being any reason or. Cause from your side. You will need to sit with them to resolve the differences. There is no other way. Else, if anyone calls and asks about definitely they will get a bad answer.
Getting to a legal council is rarely a good answer. Remember that no law can force an employer to give a good experiance letter. In fact, I don't think it's even a legal requirement for the emoloyer to give an experience letter. No such provisions of it in any law. If by chance u can force a letter, any reference check will be a disaster form you.
For proof of previous employment, u can show your salary slip (if u got any).

Hi Swati
1. Read your appointment letter properly. Remember they cannot terminate you or ask to resign with out giving any reason. Incase you have resigned then you need to be given proper time to serve you notice. Which of course will be paid.
2. Next as you said they asked you to resign, does you appointment letter says the you have to forfiet your salary in case of no notice period. Get it written from them. They cannot compell you to leave in one day if you are ready to serve your notice period.
3. Send a letter to the Labour commissioner about your situation and send a copy of the same to your employee. Take legal action only as a last resort.
4. Remember no company can take their employees for granted and refuse them their rights.
The labour commissioner letter works well.

First of all i will express my views about organisation and pepole sitting there in HR.
such type of organisation does not work in long run as they donot get good human resorces to support them.
legally it is a clause in certified standing orders to provide experience letter by mentioning so and so has worked from this date to this date.
you should consult some legal advisor locally

Hello Mallik Sir,
These type of orgnisation are not required HR only.They need someone to force the staff to obey they unethical orders.They are ready to offer me a higer salary but I would clear with them that i would like to go not just for the higer salary but also to get more knowledge in HR which is not possiable here.
