I would like to know if a letter is being sent for approval to Management (for e.g. say director/CMD) in regards to say salary hike or change of payroll of an employee, in that case is the format INCORRECT if we mention the name of the GROUP Company at the top with the address and phone number on a white A4 size paper and then the body / content of the letter into which we separately mention the payroll under which the employee is or into which payroll the employee is being shifted??? Thereafter, followed with signatures of the HR department and Management.
Will the Accounts Dept. face any legal issues?

Have attached a Format of “Office Note” wherein an employee’s salary hike is proposed. The format has been made such that the COMPANY NAME (Mother concern) has been mentioned at the top with the address, followed with the payroll (sister concern) of the employee.
Now my questions are:
1. Is the format correct?

1) Your accounts dept is correct At Top your current company name is required
2) What are the basis on which the salary hike is proposed must be mentioned as Annexure
3) For Approval not I think there is one more sign required who is going to check & recommend the salary hike.

I would suggest only one correction to approval note i.e. ABC Private limited should appear on top and not XYZ. So called mother concern has no concern with this approval for ABC Pvtl Ltd.

Are you seeking the increase of salary officially from HR/Accounts side? - Within the company you need not to use the Company Letter Head. A simple file note will solve the issue.
Are you seeking the increase of salary personally for the employee : You cannot use the company letter head for personal use.
Are you sending the increment letter for approval : The Mother concern can order the sister concern to give increment instead of seeking approval for increment. Hence the format itself is wrong.
Are you sending the increment letter after approval : Then your format is accepted. The increment letter must be given after the annual appraisal period and the copy must be given to the employee too.
The purpose of writing such letter is not clear. Eventhough there is no such legal issue in this letter, the letter is ethically wrong.
Hope you can understand the wrong thing in your letter.

Because, for internal purpose one should not use letter head etc. Plain paper is enough to get necessary approval from authorities of sister concern or main company as the case may be.
As soon as you get approval from your boss for the increment or salary revision for any of your employee, then only you require to give a letter on letter head of your sister concern and mother company has no role to play in this issue. As raised by your accounts dept on one letter head there shall not be two company names which may leads to legal problem in certain occasions in future.
