I WAS WORKING AS PROFESSOR IN UNAIDED ENGINEERING COLLEGE NEAR VADODARA AFFILIATED WITH GUJARAT TECHNOLOGICAL UNIVERSITY, RECOGNIZED BY A.I.C.T.E. OF INDIA.
I HAD TO UNDERGO ORTHOPAEDIC SURGERY DUE TO HIP JOINT FRACTURE DURING MARCH 2014. I APPLIED FOR THREE MONTHS MEDICAL LEAVE FOR RECOVERY. DUE TO OTHER MEDICAL PROBLEM, I APPLIED FOR FURTHER MEDICAL LEAVE. AS DIDNOT HAVE ANY BALANCE OF ANY KIND OF LEAVE, I HAD OPTED FOR LEAVE WITHOUT PAY. DURING SEPTEMBER 2014, WHEN I APPROACHED THE COLLEGE MANAGEMENT FOR JOINING TH DUTY, WITH FITNESS CERTIFICATE FROM THE SURGEON, I WAS NOT ALLOWED TO JOIN MY DITY AND VERBALLY TERMINATED WITHOUT GIVING ANY REASON IN WRITING. THEN I WAS VERBALLY TOLD THAT THE UNIVERSITY HAD SOME COMPLAINTS ABOUT MY EXAM DUTIES AS SENIOR SUPERVISOR.
I WROTE TO UNIVERSITY ABOUT MY COMPLAINT. I WAS TOLD BY UNIVERSITY THAT THERE WAS NO COMPLAINT. ANYWAY, I WAS VERBALLY TERMINATED.
THEN I REQUESTWD THE MANAGEMENT TO PROVIDE ME RELIEVING CUM EXPERIENCE CERTIFICATE SO THAT I CAN FIND ANOTHER JOB IN ANOTHER COLLEGE. I HAD JUST COMPLETED 60 YEARS TWO MONTHS BACK I.E. IN JULY 2014. AS PER SIXTH PAY COMMISSION , THE RETIREMENT AGE OF PROFESSOR WAS 62 YEARS.
I KEPT ON REQUESTING FOR THE SAME, BUT IT WAS NOT GIVE. ALSO I HAD TO STRUGGLE FOR GETTING MY GRATUITY FOR FOUR YEARS.
I HAVE ALREADY FILED A CASE IN GUJARAT EDUCATIONAL INSTITUTIONS SERVICES TRIBUNAL, AHMEDABAD CLAIMING 6TH PAY COMMISSION ARREARS AND ALSO BACK WAGES FOR TWO YEARS AS I COULD NOT APPROACH ANY OTHER COLLEGE IN ABSENCE OF EXPERIENCE LETTER.
CAN MY CASE BE CONSIDERED AS WRONGFUL/ILLEGAL TERMINATION AT THE FAG END OF MY SERVICE/CAREER?
CAN VERBAL TERMINATION OF A PERMANENT EMPLOYEE DUE TO LONG LEAVE WITHOUT PAY DUE TO ORTHOPAEDIC SURGERY BE CONSIDERED AS WRONGFUL/ILLEGAL TERMINATION AND HENCE ELIGIBLE FOR COMPENSATION/FULL BACK WAGES FOR THE REST OF THE YEARS?
