Hello,
We have one manufacturing site at Jejuri, so we need WC Policy instead of ESIC, reason is that according Govt.Zone Jejuri comes under Employee Compensation Policy instead of ESIC, but my one Contractor is not ready to take WC, he want ESIC for quick claim settlement for his workers than WC.
what is the solution ?

If ESI is not applicable to yourestablishment in jejuri, you need to go for Employees Compensation policy. There is no provision under ESI Act for voluntary coverage.

There is no choice It is as simple as that If ESI is applicable to your area, then cover under ESI If yours is not a notified area, Employee Compensation Act is applicable.
Either you ask him to take a policy or you take a policy and recover from his bill

Dear Sir,
We have manufacturing site at Odhav and area is covered under ESIC, we have covered all workers in ESIC but in the plant we have 10 to 12 casual workers and for them we plan to take WC policy, can we go ahead?, it is legal?
1. Legally, we can pay compensation to workers under WC polilcy if the area is covered under ESIC?
2. At present what is the wages limit under WC policy?
3. Can we take WC policy for retainer?
Please advice.......

If your plant is covered under ESI Scheme, then the contract workmen should also be covered under ESI and taking a Workmen Compensation Ploicy will not be sufficient
Please understand that the facilities under ESI and workmen compensation Act are not similar. There are provisions for Pension in case of death and pension in case of Partial disablements under ESI whereas workmen Compensation act provides for one time payments. Hence benefits are not similar Even if you take a policy, the amount needs to be settled before workmen comensation commissioner who aill not take up the case as the employees are covered under ESI
If you factory is covered under ESI, cover all employees below Rs 15000/ under ESI. There is no other choice for yo.

At present PF insepction is going on at our labour contractor place, PF inspector raised a query on pf deduction on adhoc amount which is part of wages of all contract workers ...as per act only pf is applicable on basic + DA + Food amount, Please advice.
