what if company is forcing thier employees to exceeds the maximum hour and if they speak against that they are asked to leave comapny ..is thier a way to take legal action againt them in labour laws..

If the employer is giving you the rest interval of one hour then it is as per law. Employer can take work on all the days from manday to saturday for 8 hours daily.

If the company is taking extra work i.e. OT then you are to file claim before the competent Court/ Authority. You can also lodge a complaint before the competent ofiicer of your area. If the company have the power to remove you from service then you should also examine the relief available with you. Without going through the nature of work, powers of control or supervision over others, length of service, terms & conditions of employment, remedy available under the labour or civil laws, one can not give proper advice for service matters.

In general it is 9 hours per day & 48 hours in a week. You are keep in mind both the points while determining the working hours for the employees which are covered under any of the labour laws.

In my opinion employees/staff of Govt. hospitals are governed by the State Civil Service Rules & therefore you are to examine those service Rules for your query.

Dear all,
Acc. to Factories Act 1948,
1. Weekly hours. NOT more than forty-eight hours in any week. but in a day no of hrs working can be max upto 9.
so in a factory instead of normal duty hrs of 8 we can have 9 hrs duty subjected to max working hrs in a week upto 48hrs.
2. for working of more than these hrs, written permission should be there from labour inspector or by standing orders, and for that double rate of pay should be given.
3.however, max no of hrs in a week incl. OT shall not exceed 60. AND
total OT hrs cannot exeed 50 in a quarter ( means period of three months)
