I can see people are deviating from the actual topic and making it a debate ground rather than to give individual inputs to help solve the actual problem,

Hi Abhishek,
1: I did applied for leaves extension but I wasnt aware that they were rejected; I only got to know that when I got the first letter.
I dont feel sorry for not checking as someone was ailing in my family; and it was duly informed.
2. The someone who informed the HR and others was instrcuted by the HR herself; he called me on her behalf to ask my whereabouts and I informed him that I have applied for extension and will report on March 5 which i did. I do have a copy of this email.
3. I was in UK for most part of my tenure although i am a Noida resource; once offshored I was told to go to Pune which is not my base location. So i was sent to Pune for KT purposes which I completed and I was due in Noida by 16th Feb; hence the release.
There you go! I shall be waiting for your solution.

I would appreciate if you could understand what I am trying to explain,. Its not Ravi, but his views that many are frustrated with. I see that only when he says something negative, others tend to give more clarification to their posts.

I would also suggest you to read the my post more c learly. It was an explaination to Ravi, and to help him understand that we cannot certify the HR profession as such.

And Balaji, nothing wrong in what you mentioned about me havign a soft corner for Ravi. he is a good friend of mine, and I would say my best critic. Only a critic helps you grow.

But what you criticize is also important. Ravi as a critic helps me think, and explain better. Again - its not clash of individuals, but a clash of views. Grow up with your thinking Balaji. I guess I have already told you - small people talk about other people, medium people talk about things, great people talk about ideas. See where you should be and what you should be doing for that. Dear Datsdwayitis - sorry for having to deviate from topic, but I felt it was a need to help Balaji understand.

Excellent ! I see you have all the proof. Now write an application to all the top management people ( MD, CEO, VPs, Account heads etc) copy to your HR head and others involved.
Advice -
Do not write story.
Writing should be short and simple
maintain chronological order while describing the problem
enclose all documents in the same order
If possible, highlight different key factors like date, to whom etc.
Send this letter to registered post with AD not courier.
Do not blame anyone in your letter. Seek help.
Be ready to follow up this first letter at least five times in 5 - 10 - 15 - 15 - 15 days interval , follow up shall be done through registered post with AD.
Still if you do not get any positive response, go to the labour court.
Hope you get what you want. Be honest.

Whatever, happened with you was very unfortunate and you can take legal help for sure. Since such incidents are not very common and not publicised they go very often unnoticed. Therefore going through a proper legal channel is the most appropriate next course of action that i would recommend you. The next thing is to take into confidence the media which, i feel is best bet in your case. If whatever you claim is the truth then you should go ahead with these things. Don't forget that not everybody in the industry and and this profession are bad. After all we are all human beings at the end of the day. I wish you all the very best in all your future endeavors.

It's unfair and absolutely unprofessional on your part to defame the entire HR Community on the whole. If you don't know the profession the least you can do is to respect it..

my suggestion
keep looking for a job and post your query to <link outdated-removed> to findout the labour laws...they people will definately give u a way!!

Hi,
You were asking seniors to reply on this. But, i think i'm not that much senior to reply here and i dont have anything else than the above posts.
I can clear one thing, if u have all necessary documents and proof, u can approach labour court. But again, You might have know the time of settlement of a case by a court ! ! !
Think and confirm yourself before moving ahead.
And Mr. Ravi you might have a very bad experience with some HR person in your company or earlier, it may be your personal one. Dont see any individual or situation narrowly like this. Every one has their own limitations. Hope u understood!!!???

Dear Ash,
My intention was not to make anyone feel offended. I do read each and every post and try to analyze what is hidden between words.
You might be great friends with Ravi but than there are certain things that are not supposed to be discussed at the place where there are number of people who might feel offended (me being one of them).
Any word against HR without prior homework and without knowing the fact about the thread excites me (personally).
Anyways i hope now the friend who has posted thread might be very clear on what we are suppose to do in order to get rid of such hassles.
Do not bother too much about it, file a case with all relevant documents(hand written as well as electronic), and forget it.
I hope now there should not be much of the discussion on this thread as it will add to more complexity for the person who is really in need.

Dear Friend,

I fully read your presentation. If anyone working abroad happens to come to native country on vacation or emergency, it is advisable that they be in touch with the organisation / Team Head and maintain contact. When they had sent a mail to Pune, you were in Punjab which they didn't know. For various reasons, they will contact you only at the contact address furnished by you in case of emergency. So it is a case of communication gap which had jeopardised you as 'absconding'.

Either it appears that the company has no strong leave policy or you were unaware of the existing policy in force. Since you have stated it as an MNC, I think you have to deal with it with patience.

It is always customary that friends keep in touch and appraise the fellow on happenings in office when he is on a long leave.

As a victim, your words prove innocence but we have to look into the matter as a corporate HR guy with proof and authenticity on table. Always we go by records and evidences only.

Hi Chandrasekar,
I feel what you are saying mate, but there was no such confusion I had kept everyone informed. I left Pune b4 I applied for leaves and everyone was aware that my father in law is ill and in Punjab.
As a calculated thought and with a lot of suggestions I do feel that filing a case will sort matters out.
I'd like to hope that the legal notice serves my purpose and i may not have to drag the company tot he court.
No one can imagine how hard it is for me to withhold the name of the company bcuz I so want to show the world what kind of a stupid HR this company has. But again I wouldnt risk the name of all the company for this one stupid woman( no offence against Women ). THis company has presence everywhere in India plus abroad with 25000+ members.
And its been in the names quite recently with regards to Satyam; now I know 99% of you can guess the name but please dont write it out.
Thanks everyone for their help and suggestions.
I shall keep the forum informed.
