First of all, you started the discussion of gratuity in the wrong thread of PF. The subject of gratuity for 4 years and 240 days has been well discussed earlier in this forum on a number of occasions. The said judgment is also available in many discussions. You are requested to do research on it.
Please note the following:
1. The said judgment is binding only in the jurisdiction of HC Madras.
2. There is no question of paying gratuity for 4 years and less than 240 days, as you raised the query.
3. There is no question of paying gratuity for less than 5 years of service except in the case of death.
4. For gratuity on 4 years and 190 days, you need to bring a fresh judgment.
