whether Security guards engaged by a principal employer (having office in implemented areas) through a security agencies (not having office in implemented areas/ having office in implemented area) for patrolling cross country pipelines that passes through both implemented and non implemented area across many states will be covered by ESIC.

1. Sir, yes in my opinion, such employees will be covered.
2. In case there are any contractor employees who are permanently posted in non-implemented areas for more than 7 months, you can seek their exemption from coverage under ESI Act, 1948 and rules/regulations framed thereunder.
3. If you have any doubt, I think, it will be safe to consult in writing to the appropriate Region/Sub Regional Office of ESIC to which your unit is attached.

establishment situated in non implemented area and registered office also in non implemented area and brances are in implemented area but whethere i have to deduct esic to whole employees or only the employees situated in implemented area.

Sir, though the contribution is required to be deducted in respect of employees who are working in such units which are located in implemented areas, but since some times, ESIC had started implementing the Act throughout all districts of a State. Therefore, it will be more appropriate if you make correspondence with the appropriate Regional/Sub Regional Office of ESIC to which your unit is attached and inform them about the units of your establishment which fall under non-implemented areas and ask them to confirm.
