Yes, A single person can be a factory Manager for 2 plants. A separate Factory License should be obtain for both the plants with same factory Manager / Occupier. S B Ramesh

Kindly ask your consultant as to which provision of Factories Act or Rule prohibits a person being nominated as manager for more than one unit.There are four persons referred to in Factories Act

1. Occupier

2. Manager

3. welfare officer

4. Safety Officer

Occupier nominates a Manager. If he does not nominate or if a nominated Manager resigns, the Occupier will be the Manager unless it is proved with facts that someone else is acting as Manager. Act does not provide duties of a Manager. Welfare officer a nd Safety officers can not be nominated for other units. But Manager can be. It is not even necessary that his name has to be in the Muster Roll. However, it is expected that attends to day to day functions of the Unit. You can not appoint a Consultant who will come once a week as Manager.If the unit is located outside the city, it will be presumed that the person can not oversee day to day operations. Hence there may be requirement of another person who is located there as Manager. But if you have two units in the same city, since the law does not prohibit, the Occupies can nominate the same person as Manager for two units.

If one goes through the Rules in different States, you will find that the Manager is responsible more for maintenanc eof registers and sending information the Inspector. Wherever, major issues are involved, the Act talks about the Occupier and in some cases Occupier and Manager. But nowhere there had been a prohibition about a person being appointed as Manager for more than one Unit.

1. Occupier Can be same of both units
2. company name can be same only one is unit-I and another is unit-II
3. ESIC and EPF registration can be one for both the company. with branch addition if same local office concerned
4. Salary Sheet can be mantain separate for both the unit.
But here your question regarding Factory Manager and Factory Act return
SO as per rules the the establishment location and registration no. of factory is different so separate return required for both factory,
the manager can be same for both factory but the act says that
( During any period for which no person has been designated as
manager of a factory or during which the person designated does not
manage the factory, any person found acting as manage, or if no such
person is found, the occupier himself, shall be deemed to be the
manager of the factory for the purposes of this Act.)

one person can not be the manager for two industries at on time.
a industries have under one licence may different branch like you . i hope you have applied factory licence as one for both the units. let it be cleared.
if yes than one person shall have valid for manager for both the units.
if both unit have separate licence than a person can not be manager for two units.
factory act prohibited one person as a manager for two units having separate identity.
a person may be occupier for several unit.
but a person can't be manager more than one for independent unit.

Does the Factories Act really prohibit? Under what section. I had been going through the Act and Rules of some of the States and could not find any such prohibition. In the absence of any specific prohibition, legally we can not say that a manager can not be nominated for two factories

Hi all
For your kind information Factory License is separate for both the units and according to me also occupier can be one of many units but Factory Manger cannot be one person but many members who have given their view in this matter created confusion that can be .
So plz legally correct and explain me

Dear Mr Rawat
As I kept saying, the Act does not prohibit anywhere appointment of Manager for only one factory I have in my career nominated same Manager for different Units. For your sake, I also went through the Act again and rules of Maharashtra, Tamilnadu and Karnataka
I have not come across with any such clause prohibiting a Manager being appointed for more than one unit

The \'Manager \' is not defined in the Act.It is defined in the state rules which is \'the manager means the person responsible to the occupier for the working of the factory for the purpose of the Act.\'Usually the person who is in charge of the day today function of the factory is made the manager.If the factories are in same place practically one can be Manager for many factories.But if
one factory is in Gouhati and another is in Kerala one cannot do that function although Factories Act do not prevent it.

Occupier has to be Board of Director who has ultimate control and may be having more than one factory under the Compnay can be appointed for more than one factory. Since factory manager is appointed for that factory and is working in the plant for managing the work has to be one for that factory only.
