Now that he has not returned the co.'s access card which is a serious issue, send him a mail through register post to confirm his resignation( as you have mentioned earlier about his intention to resign that was casually communicated to you) and ask him to return the access card and what ever co.'s property that he has to return.
By sending this communication we are legally binding the employee to respond, failing which he would be liable to legal action.Inspite of that if he is not responding and that your SR. Mgt wants you to proceed with legal action, you can take advise of a legal advisor/ advocate who deals such cases and proceed.
