Hello guys,

I need help with the issue mentioned below. My friend has resigned from the position of a software engineer, but the company is not accepting the resignation. They are stating that there is a service agreement of 2 years (bond) in place and there is a project dependency on him.

However, my friend does not want to continue working there as he has found a new job. Due to this reason, he is leaving now, but the current company is not accepting his resignation.

Please assist me with this matter.

Bonded labor has been abolished for a long time. You could approach the district labor officer if they are still not accepting your notice of resignation. Before taking any harsh actions against your friend's current employer, you may advise him to settle the matter amicably.

Has he signed a bond? What are the terms of the bond? What value-add has the organization provided to your friend in lieu of the bond? Has international training been provided where a substantial amount of money has been spent? Unless there is going to be a tangible loss on account of the investment made for training, the bond is not valid. Your friend can approach the labor officer of the concerned circle. Before that, ask your friend to write to them that the bond is not valid and bonded labor is abolished by the government. Let him caution them that he will be approaching the labor officer if they do not relieve him.
