Dear Anonymous,
In the state of Maharashtra in case of an establishment which is a hotel, 20 or more employees are required for the coverage under the Act. This is vide notification of ESI No.1677/3910.PH-15 dared 18.09.1978. Once coverage is there, inspection can be made by the authorities under the Act.

Hi,
COFF is not a leave in actual. it is a off provided against working on weekly off. that means COFF is an Adjusted weekly off (i.e. off for compensating working on weekly off). that means you are providing the concerned employee with weekly off (Adjusted) against his weekly off on sunday. he is getting weekly off on saturday (Adjusted weekly off -COFF) and his actual weekly off Sunday so his actual leave starts on monday. so sunday is not clubbing with his leave.

This is called the sandwich rule of leave. There is no legal provision governing this. So it all depends upon the policy of the company.
In my opinion if you do not have anything written on the same in your policies, you should not club it. As that will be deemed to be detrimental to the interest of the employee and before implementing anything or before any rule that may be considered as detrimental to the interest of employee you will have to serve notice as per the requirement of Section 9A of Industrial Disputes Act. Also it is a comp off, Employee worked on a weekly off means worked for around 13 days without a leave. Now let him enjoy and have fun for a couple of days. Be a good HR and supportive to Employees.

Hi,
Please formulate leave policy , procedure and process, workflow and templates.
Simple solution can be :
If an employee is required to perform duties on a Saturday /Sunday or on a closed holiday may be given compensatory leave for a corresponding number of days provided that he/she will not be entitled to draw any overtime allowance admissible to him/her for those days. PROVIDED further that compensatory leave shall not be accumulated by an employee for more than three days.

As per factories act if employee needs to work on weekly off then he should be given one compensatory off.
employee should not work for more than ten days without off.
as per practice compensatory off if come across weekly off with another leave then the weekly off does not lapse. this rule of sandwich applies only in case of PL, CL and LWP and not for Coff.
e.g. If employee takes coff on saturday, sunday is weekly off and monday is PL then his weekly off does not lapse. but if Saturday is PL, Sunday is weekly off and Monday is PL then weekly off should be considered as PL.

Dear Mr. Prasad, If Saturday is Compensatory off day then Sunday will be Off day. If Saturday will be on leave then Sunday will count with leave. Rajeev

Sunday in this case will be considered as a weekly off and not a leave.
Sunday would have been considered as a leave only in the case where your company followed the Sandwich policy and the Employee had taken a leave on Friday as well. In this case, he took Saturday as a CO. Hence it should not be counted under leave.

No..Its not the same in case of permitted leave.
I mean to say..if an employee takes off from his duties without any prior permission then the Sunday(normal week off) which may come between his long absent is considered as absent. but in other case, if he applies and takes permission for a long leave including Sunday, then Sunday will be considered as paid holiday. and other days are considered as leave(CL/EL/SL).
As per Factories act, one day off should be given in a week. its not particularly Sunday, but company can fix any day in a week as week off. Along with working hours, week off day also to be displayed in the notice board.
So, Sunday is the fixed holiday if in case worked for continuous 6 days in a week. but in case absence from work, then its not necessary to give week off and this day also to be considered as absent.
Further please check with the seniors.
