Dear All,
I need your urgent help regarding my situation,
I used to work for Wipro Ltd, IT giant sector, now I have given resignation via online portal after my 2 years sabbatical leave period. As still am pursuing master's abroad and it is going to complete by December 2017, so as per my current situation I cannot return to India and rejoin the company. Now I got an email from Compliance HRSS stating that after resignation I was absent from work without any approval from 3rd July, 2017 to till date and they are saying I breach Wipro's code of conduct which is written in the offer letter, where as I was sending emails to them to release me but no one had responded my emails. And now, they says come to work immediately and give the written explanation.
But, at the time of resigning I clearly mentioned in comments that I cannot come and rejoin company due to my higher studies. I would like to resign with my free will and consent but they are asking me come to work and give written explanation.
Request all to suggest me in that case what should I write to HR to release me from the company without any trouble. Please help.

Dear Syed,
Your sabbatical was of 2-year duration. But when it was due to end? In your communication with your employer, did you intimate about the extension of your education course as a consequence to this extension, did you ask for the extension of sabbatical also? Why did you give resignation instead of asking for extension of sabbatical?
I recommend writing letter to HR Head of your organisation. In this letter, write in chronological sequence the communication that you had with HR. Include copies of your past correspondence as attachments and the letter that you have received from HR. Take a certificate from your education institute or university on likely completion of date of your course. Attach it to your application.
Take a printout of your application as well as attachments and send it by post to the Head HR. Keep the docket or receipt from the post office with you.
Once you do all this, let us wait for your employer to respond. Further suggestions will be given based on their response.
Thanks,

Dear Dinesh,
Thanks a ton for your suggestion and I follow the same.
My sabbatical was ended on 2nd of July. I clearly mentioned in the resignation comments that I will be graduating in December 2017. And, once I complete my degree I will be glad to rejoin same company abroad. I sent an email to HR and Resource manager many times to release me but didn't get any response from them. As per the policy I am sure, they don't extend my leave.
Moreover, my assignments are going on at the University, so in my current situation I cannot return and rejoin the company.

Dear Syed,
As stated in the previous post, you should have asked for the extension of sabbatical and should not have submitted letter of resignation. Instead of acceding to your request, if the company had advised you to submit resignation, you could have done that. Secondly, I doubt you had sent letter of resignation along with the certificate from your university. Therefore, partially the confusion is because of improper communication.
When did you give letter of resignation? Was it before 02-Jul-2017 or after that? If you have submitted after the due date then company authorities might have perceived that yours might not be genuine case and extension on sabbatical might have been asked on flimsy grounds.
If there was no communication on your resignation and subsequent reminders, why you did not give telephone call to your company? If the particular medium of communication was not effective, you could have chosen another medium and that is telephonic communication. In my previous post, I have told you to write application addressed to the Head HR. However, before doing that even now also you may give a call and find out who exactly is dealing with your case. Address the letter to him with copy to Head HR.
Lastly, usage of the word "rejoin" in your letter of resignation was not required. In case if you had left the employment, then you could have rejoined. But those who proceed on sabbatical, they remain on the rolls of the company. Sabbatical is nothing but long leave and it could be with or without pay. However, on completion of leave, employees "resume their duties" and not "rejoin".
