It is correct that the Factories Act, 1948 provides us the provisions of annual leave with wages in chapter VIII of this Act while CL & SL are allowed under the State Industrial Establishment ( National & Festival and Casual & Sick Leaves) Act. Therefore go through this Act for these leaves.After going through these minimum statutory leaves you may go through leave policies as provided at different threads & prepare this as per your requirement. As we all know that 2nd October is a national holiday & the provisions relating to grant of national holidays are governed by the State Laws i.e. either under State Industrial Establishment ( N F holidays and C & S leaves) Act or State Shops & Establishment Act & therefore first decide which of the act is applicable for grant of National Holiday & then go through the applicable Act to know the consequence of not granting this holiday.

you can keep your factory open , but that day you need to pay double salary to the employees. only 15th August and 26th January you need to close. Rest on any national holidays you can keep the factory open as in FMCG labourers are involved and manufacturing cannot be stopped. We ourself apply same rule for our garment printing division.
