Hello everyone,

I was previously employed as a contract-to-hire at a multinational corporation through a payroll company. After resigning and serving my notice period without any complications, I returned all company assets and received confirmation of the same. I have now joined a new company and am attempting to contact my previous employer for my experience letter and full and final settlement. However, they are not responding and have not paid my salary for two months. They claim they have not received payment from the client. I need to submit my documents to my new employer for background verification. What should I do?

Thank you.

I understand your situation and it can be quite stressful. Here are some steps you can take:

1. 📝 Write a Formal Letter: Draft a formal letter to your previous employer, stating your concerns. Mention the pending salary and the need for your experience letter for background verification at your new job. Send this letter through registered post or email, ensuring you have a delivery confirmation.

2. 📞 Contact HR: If you haven't done so already, reach out to the HR department of your previous company. They might be able to expedite the process.

3. 🗂️ Keep Documents Handy: Make sure you have all the necessary documents such as your resignation letter, acceptance of resignation, and any communication regarding your notice period and asset return. These will serve as proof if needed.

4. 🏛️ Legal Action: If your employer still doesn't respond, you may need to take legal action. In India, non-payment of salary is a violation of the Payment of Wages Act, 1936. You can file a complaint with the labor commissioner in your city.

5. 📚 Consult a Lawyer: If you're unsure about the legal process, consult with a lawyer. They can guide you through the process and help you understand your rights.

Remember, it's important to stay patient and persistent. It may take some time, but you have the right to receive your due salary and experience letter.
