Mr Rana sir,
please sort out my problem as well, willing to leave my present company but there is a clause in the appointment letter which says:
" In event of your resigning before completing 12 months of service in our organization, you would be liable to pay a 12 months salary as compensation towards your expenses incurred for your training etc."
this clause is mentioned in the appointment letter of every employee whether a fresher or an Experienced, whether at junior level or at some higher position.
Now Mr Rana please guide me if i leave the organization before completing 12 months can this clause make the company eligible to take any legal action against me or it is just a tool to retain a candidate for at least one year.
the environment in the organization is so negative, even my manager is not supportive towards me. all the just makes me sit empty hands, does not teach me anything as I am a fresher and neither gives me any guidance nor any task to perform, if I try to do something on my own she says why you did that? who permitted you? you are not allowed to do any such thing.
since joining I am only using internet and surfing lot of websites and trying to add some knowledge & skills. but for a last few days my system does not have access to any network
i do not know what to do, i am fed up of my manager's behavior and willing to leave the company as soon as i will be having a new job. please help me out what to do and how to handle this situation.
it is just a start of my career and i dont want to spoil it anyhow.

RANA SIR, i have given no such training, i am only observing what my manager is doing and along with that helping them in performing minor tasks. otherwise sitting idle most of the times.

pramod, no trainings till now mean you can challenge the bond. keep evidence handy.
there could be a different situation too, they hire freshers and dont want to lose out on employees after training them..
that is the reason why they asked you to sign a bond..
trainings need not be formal always, it can skills aquired on the job too.
best thing to do, sit with your manager and discuss.
ideally he should brief you on what strengths they have identified in you/ which training would you be undergoing/ where would you be working/ career path..
then decide your future course of action,
to keep yourself on the safe side, you can send him a mail too ..dont mention anything which can go against you..

i am also thinking about to sit and communicate thoroughly to discuss what they actually want. and will surely discuss my state of mind as well.
but i do not have that much of courage well i am trying to collect all my strengths and will talk with her today itself.
sir what type of evidence you are talking about in my case?

evidence could be emails/ documents/ etc that supports your stand later..
you have mentioned that the clause of "12 months salary in lieu of training" is mentioned in every appt letter across the company.
keep copies of signed contract letters for a couple of positions to safeguard yourself. pick positions which are exp "manager and above"..
this is an unfair practise..
i have been associated with a company wherein the entire staff was on fixed term contract...not a single employee was on indefinite employment.. the owner had faced a strike in the past and the company lost crores.. after that he never kept any employee on the rolls.
career is most imp, learning is the key...
one needs to work in a place with good learning curve...learning makes us marketable..

what do you think..SMEs and growing companies involve themselves into legal course of actions? doesn't it harm there repute in the market and in the court of law?
